PLEASE READ THIS RENTAL AGREEMENT CAREFULLY. BY CLICKING “I ACCEPT”, BY PLACING AN ORDER FOR RENTAL OF ANY RENTAL PRODUCTS, OR BY ACCEPTING DELIVERY OF ANY RENTAL PRODUCTS, YOU: (A) ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS RENTAL AGREEMENT AND BY SUCH OTHER TERMS, CONDITIONS, POLICIES, AND DOCUMENTS THAT MAY BE INCORPORATED HEREIN BY REFERENCE.
TINY TREK RENTALS MAY REFUSE TO RENT OR OTHERWISE TERMINATE YOUR RENTAL OF ANY RENTAL PRODUCTS FOR YOUR NONCOMPLIANCE WITH ANY PART OF THIS RENTAL AGREEMENT. THIS RENTAL AGREEMENT IS VOID WHERE PROHIBITED BY LAW, AND ANY RIGHTS TO ACCESS OR USE THE SERVICE OR RENT ANY RENTAL PRODUCTS HEREUNDER ARE REVOKED IN SUCH JURISDICTIONS.
- Rental Agreement:
1.1. By renting equipment from Tiny Trek Rentals, the customer agrees to be bound by the terms and conditions outlined in this rental agreement. The rented equipment remains the property of Tiny Trek Rentals at all times.
1.2. The rental agreement will specify the rental period, rental fees, security deposit, and any other applicable charges. The customer must review and agree to these terms before the rental period begins.
- Proper Use:
2.1. The customer agrees to use the rented equipment according to the manufacturer’s instructions and guidelines. Any misuse, improper handling, or failure to follow instructions may result in additional charges, termination of the rental agreement, and potential liability for any resulting damages or injuries.
2.2. The customer shall ensure that the rented equipment is used only by individuals who are capable and competent in its proper operation and have received any necessary training or instruction.
- Inspection:
3.1. The customer is responsible for inspecting the rented equipment upon receipt and notifying Tiny Trek Rentals of any damage, malfunction, or missing components before use. Failure to do so may result in the customer being held liable for any issues discovered after the rental period begins.
3.2. If the rented equipment is found to be unsatisfactory or unsuitable for the customer’s intended use, the customer must notify Tiny Trek Rentals immediately. Tiny Trek Rentals will make reasonable efforts to provide a suitable replacement or address the issue, if possible.
- Maintenance:
4.1. The customer agrees to maintain the rented equipment in good working condition, ensuring cleanliness and proper storage when not in use. The customer shall not attempt to repair, alter, or modify the equipment without the prior written consent of Tiny Trek Rentals.
4.2. The customer is responsible for any costs associated with the repair or replacement of rented equipment due to damage caused by misuse, neglect, or failure to follow the manufacturer’s instructions.
- Return:
5.1. The customer agrees to return the rented equipment in the same condition as received, with all accessories and components included. The equipment must be returned on or before the due date specified in the rental agreement.
5.2. Failure to return the equipment on time or in satisfactory condition may result in additional charges, including late fees and replacement costs. If the rented equipment is not returned within [X days] after the due date, Tiny Trek Rentals may consider it lost or stolen and may pursue legal action to recover the equipment or its value.
- Liability and Indemnification:
6.1. Assumption of Risk: The customer acknowledges and agrees that the use of rented equipment from Tiny Trek Rentals may carry inherent risks, including the risk of personal injury or property damage. The customer assumes all risks associated with the use, operation, and possession of the rented equipment during the rental period.
6.2. Limitation of Liability: To the maximum extent permitted by law, Tiny Trek Rentals shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or any loss of profits or revenue, loss of use, loss of data, or any other intangible losses, arising out of or in connection with the rented equipment, whether based on warranty, contract, tort (including negligence), or any other legal theory.
6.3. Indemnification: The customer agrees to indemnify, defend, and hold harmless Tiny Trek Rentals, its owners, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that arise from or relate to the customer’s use, operation, or possession of the rented equipment, including any claims of personal injury, property damage, or breach of this rental agreement. This indemnification obligation will survive the termination of the rental agreement and the rental period.
- Cancellation Policy:
7.1. If the customer needs to cancel a reservation, they must provide at least 72 hours notice before the scheduled pickup or delivery date. Failure to provide timely notice may result in cancellation fees as determined by Tiny Trek Rentals.
7.2. Tiny Trek Rentals reserves the right to cancel any rental agreement at its discretion, with or without notice, in the event of any breach of the terms and conditions by the customer, or if it deems that the rented equipment may be at risk of damage or loss.
- Security Deposit:
8.1. A security deposit may be required for certain rental items. The deposit will be refunded upon the return of the equipment in good condition, minus any charges for damages, cleaning, or late returns.
8.2. Tiny Trek Rentals reserves the right to withhold all or a portion of the security deposit
